Uncle Syndrome.
Uncle syndrome
The syndrome is all over India including Delhi also. Please visit any High court Bench or main seat of any High Court and will see more than one uncle. But no one should blame these uncles because these uncles have also uncles at Delhi Darbar too. Unfortunately a domestic matter which could be solved by writing a confidential letter to the Chief Justice of Allahabad High Court was written in an order by the Supreme Court was made publicly. By doing so the judiciary has not raised its standard. What to writ and what not to write in an order or judgment is totally the jurisdiction of the court concern but the general public is affected by such remarks. Things are not as simple as they seem. A Supreme Court Judge resigns in the evening and submits nomination form for Rajaya Sabha on next day on behalf of Congress. Another judge who after retirement was chairman of a state administrative Tribunal resigned in night and next day submitted nomination form for Rajaya Sabha on behalf of Congress. Another judge of the Supreme Court retires on a day and next day was appointed as Lokayuct of a state.There used to be rumors that he had in his tenured favoured big booses of the state. A retired judge of a High Court used to be head of mostly all Commissions appointed by the said state government. His relations had affiliations with congress. It does not end here. Another judge also works as the chairman of the commissions and his tenure as chairman is more than his High court judgeship. Another Supreme Court Judge, next day after his retirement gives interview to a news channel and abuses Narendra Modi to his maximum satisfaction. Yet another Judge of the Supreme Court in Hydrabad says that due to media (as if media is his uncle) the courts find difficult to pass orders on bail applications. There was another Chief justice in whose regime the title of “senior Advocate’ was conferred on number of advocates whose competency could be questioned and who are not yet able to speak fluently in Hindi or English and knows little about law. Such titles were conferred more generously than alms! Why it so happens at high level and in high judiciary. Kucch To hai Re Mere Bhaiyaa! Some black sheep of power is spoiling the judiciary. It is humbly requested that such black sheep may not be dumped in M.P.High Court where in spite of so many demerits such problem of uncle syndrome is not faced by that Court. I would like to request to read the book entitled as ‘The other side of justice by the then Chief Justice of Allahabad High Court Justice S.S.Sodhy.
On the other had Distinct Judiciary has no such problem. Perhaps it knows the doctrine of “know thy self”. District level judges know their limits and also know how long they should spare their wings. These judges may lack in legal knowledge to some extent and may lack in proper training but large number of them are quite honest. They say that due to the dishonest judiciary they have to drink the jorum of insult. Any how what is happening is not good for judiciary and every judge of any rank should remember that threat is not from out side but from inside. It should also be remembered that all are the part and parcel of the same judiciary and sailing in the same boat and in the same sea and therefore threat to one is threat to all. No one is exception.
